En effet, cette chaleur persistante peut avoir des r\u00e9percussions sur la sant\u00e9 et la s\u00e9curit\u00e9 du personnel. En tant qu\u2019employeur, vous connaissez sans doute les dispositions de la l\u00e9gislation relative au \u2018 bien-\u00eatre au travail \u2019, mais saviez-vous qu\u2019il est \u00e9galement possible de recourir au ch\u00f4mage partiel pour cause de conditions m\u00e9t\u00e9orologiques d\u00e9favorables en cas de canicule ? <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vous pouvez consulter le site du SPF Bien-\u00eatre sur leur <a href=\"https:\/\/emploi.belgique.be\/fr\/themes\/bien-etre-au-travail\/facteurs-denvironnement-et-agents%20physiques\/ambiances-thermiques\/droits\">site web <\/a>. Le texte int\u00e9gral de la l\u00e9gislation relative \u00e0 l'\u00e9valuation des risques \u00e0 r\u00e9aliser, ainsi qu'aux mesures techniques envisageables (par exemple, le refroidissement de l'air ambiant, etc.) et aux mesures organisationnelles (par exemple, la modification des horaires de travail, etc.), est disponible via ce lien <a href=\"https:\/\/emploi.belgique.be\/sites\/default\/files\/content\/documents\/Bien%20%C3%AAtre%20au%20travail\/R%C3%A9glementation\/Code%20livre%20V%20titre%201%20%20Ambiances%20thermiques\">lien<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans des circonstances exceptionnelles, l'employeur peut, \u00e0 la suite de perturbations persistantes et apr\u00e8s avoir mis en \u0153uvre diverses mesures, d\u00e9cider de recourir au ch\u00f4mage partiel. Le ch\u00f4mage partiel est possible lorsque : <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>toutes les mesures pr\u00e9ventives ont \u00e9t\u00e9 prises ; et<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>le travail devient objectivement impossible en raison de la chaleur. <\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">La chaleur peut \u00eatre consid\u00e9r\u00e9e comme une \u2018 condition m\u00e9t\u00e9orologique d\u00e9favorable \u2019 si :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les conditions m\u00e9t\u00e9orologiques sont exceptionnelles ; et <\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ces conditions rendent l'ex\u00e9cution des travaux impossible ; et <\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Il existe un lien direct vers cette \u0153uvre. <\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">L'employeur doit \u00eatre en mesure de justifier et de prouver cette situation aupr\u00e8s de l'ONEM, et les formalit\u00e9s (d\u00e9claration \u00e0 l'ONEM, formulaire C3.2A, etc.) doivent \u00eatre strictement respect\u00e9es. Il est conseill\u00e9 de contacter l'ONEM, qui doit approuver le dossier. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ces formalit\u00e9s sont les suivantes :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Informer les salari\u00e9s avant le d\u00e9but de la p\u00e9riode de ch\u00f4mage temporaire ; <\/li>\n\n\n\n<li>D\u00e9clarer chaque mois la premi\u00e8re journ\u00e9e effective de ch\u00f4mage due \u00e0 des conditions m\u00e9t\u00e9orologiques d\u00e9favorables pour chaque salari\u00e9 ; joindre la fiche de contr\u00f4le C3.2A (le cas \u00e9ch\u00e9ant) ; <\/li>\n\n\n\n<li>Envoyer la d\u00e9claration de sc\u00e9nario ASR (si n\u00e9cessaire) ; <\/li>\n\n\n\n<li>Envoyez la d\u00e9claration relative au sc\u00e9nario 5 de l'ASR \u00e0 la fin de chaque mois. <\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Vous trouverez toutes les informations n\u00e9cessaires via ce lien <a href=\"https:\/\/www.onem.be\/employeurs\/chomage-temporaire\/chomage-temporaire---intemperies\">lien<\/a>.
